We did not list any Easements under this
heading, but rJid include the easements under other appropriate sections and
where the easement should be considered.
41e accept that the easement is permanent and will remain in effect during the
mining operation. We have discussed and will continue to work with the Division
throughout the operation to maximize the combined use of the property,
The intent in the lease with Loveland Excavating was to grant them sole and ex-
clusive possession regarding the mineral extraction. An amendment is being made
t.o this lease to clarify that ttre owners of all er,isting easements will retain
tYreir respective easement rights.
We also recognize that a water augumentation plan be approved,by the State
Engineer and the Water Courts, This plan will address the water use during the
mining operation and water rights for the "change in use" of the property, ie,
after completion, We intend to keep the Division of Wildlife informed as this
application proceeds through channels,
rV1cRF :;~ifJR•IN1L~
1227 - 8th Avenue
Greeley, Colorado 80631
Telephone (303) 356-3101
