(a) The pennittee may allow any oypass to occur which noes Hoc cause

essential maintenance to assure efticl'ent operation. Division

(o) Bypass is prohibited, and the Division nay take enfcrce,nent action
against a pennittee for oypass, unless:
(i) Bypass was unavoidable to prevent lcss of ltte, perso++al
in,7ury, or severe property amnage;
(ii) There were no feasible alternatives to the oypass, sucn as
the use of auxiliary treatment taciltttes, retention of un-
treated wastes, or +naintenance auriny rtonnal periods of
equtpment downtime. Thts condition is not satisfies tf the
pennittee could have installed adequate oackup equipment co

2. Reauccton, Loss, or Failure of Treatment Facility
