An upset <br />does not include noncompliance to the extent caused oy <br />operational error, improperly designed treaunenc <br />facilities, inadequate treat~rtnt facilities, lack of <br />preventive maintenance, or careless or impro;,er operation. <br />• (b) flonccmpliance Notification <br />(i) [f, for any reason, the penrrittee noes not car~ply with ur. <br />will be unaole to ca~~ply with any maximum aiscnarge <br />limitations, or standards or conditions specified in this <br />permit, the pennittee shall, at a minimum, provide the <br />Water quality Control Division and tPN with the following <br />information: <br />(i) A description of the aiscnarge and cause of non- <br />canpliance. <br />(1) The period of noncanpliance, including exact uates <br />and tunes ono/or the anticipated time when [nz ais- <br />cnarge will return to canpliance; and <br />(3) Steps oeing takzn to reduce, eliminate, and ,,revent <br />recurrence of the noncanplying aiscnarge. <br />(ii) Tl~e following instances of noncompliance shall oe repurteo <br />orally within twenty-four (CJ) hours from tn~ time the <br />pernittee oeca~~es aware or tr.e crrcwnstances, and a <br />written report mailed :vi[hin five (S) nays of the ti~~~E tnz <br />permittee octanes aware of the circumstances: <br />(1) 'u,y instance of noncompliance •wnicn may endanger <br />hedl[h or the envirornnent <br />
