Canany <br />Division Director <br /> Natural Resource Trustee <br />Lakewood, Colorado 80228 _ / <br />Re: Whirlwind Mine,/Fi/le No. M-2007-/044, Completness of 112d Hard Rock Reclamation Permit Application <br />Package <br />Dear Mr. Filar: <br />On Juty 23, 2007, the Division of Reclamation, Mining and Safety received Energy Fuel's outstanding required <br />documentation fora 112 Designated Mining Operation Hard Rock Reclamation Permit Application package for the <br />Whirlwind Mine, File No. M-2007-044. The application now appears to meet the minimum requirements of <br />completeness for staff review. Based on the amount of information for water, geo-chemical analysis and engineering that <br />is required fora 112 DMO, the Division is calling the application complex. The complex designation allows the Division <br />an additional 60 days beyond the normal 90 for a normal 112 permit per Rule 1.4.1(7). Therefore, the Decision Date for <br />In the event that there are objections to the permit application, the Division makes a recommendation on the application <br />and a decision would be made by the Mined Land Reclamation Board at its January 9'", 2008 hearing.
