Huskin Construction Company, Velazde Pit <br />112c Permit Application, File No. M-2002-118 <br />Dear Mr. Oehler: <br />This letter will answer your list of items addressed in your correspondence dated <br />February 25, 2004. I will address each item in the same order that you listed them. <br />EXHIBIT D-MINING PLAN <br />6.) The applicant D.G. Huskin Construction, Company will prepare a Storm Water <br />Management Plan (SWMP) and a Spill Prevention Control and Counter measure (SPCC) <br />plan, for this site. As you know each SPCC plan, while unique to the facility it covers, <br />must include certain elements. The elements required are that the SPCC plan be cazefully <br />thought out, prepared in accordance with good engineering practices, and should address <br />operating procedures that prevent oil spills; control measures installed to prevent a spill <br />from reaching navigatable waters; and counter measures to contain, clean up, and <br />mitigate the effects of an oil spill that reaches navigable waters. To meet the above <br />requirements a Storm Water Management Plan and a Fuel Berm Management Plan, plus <br />a Spill Prevention Control and Counter Measure Plan will be done for this site. A permit <br />from the Colorado dept. of Health & Environment Water Quality Control Division will <br />also be obtained. Copies of all of the above plans and permits will also be sent to the <br />Division of Minerals & Geology. <br />The asphalt plant that will be used on this site has three (3) main storage tanks; they are <br />as follows SS#1 (tack oil) 7,500 gallons, Asphalt 10,000 gallons and the Fuel tank 10,000 <br />gallons. Along with the list tanks small container of lubricants will be stored on site. To <br />contain the fluids if a tank should fail an earthen berm will have been constructed azound <br />
