CFSI subject to Lessee's license to use such water on the Prem- ises only during the term of this Lease in connection with its mining operations on the Premises. (b) If at any time Lessee considers abandonment of any water rights used or acquired by Lessee pursuant Ireteto, Lessee shall first notify CFSI of such intent and shall allow CFSI 90 days, in which to determine whether it agrees that such water rights should be abandoned. Lessee agrees not to abandon any such rights if CFSI determines such rights should be re- tained. (c) Nothing contained herein shall be construed to prevent CFSI from developing or using water for its own pur- poses on or off the Prernisea in a manner that does not inter- fere with Lessee's operations. 7.7 Labor and Materials. Lessee shall provide and promptly pay for all of its labor, materials and other sums relating to third-party contractiny services on the Premises, Lessee agrees to indemnify CFSI and agrees to }rold CFSI free and harmless from any claim, charge, cause of action or damage based upon or arising out of or in connection with Lessee's ~ acts hereunder, in regard to the furnishing of labor and the acquisition of materials and supplies. 7.8 Taxes. Duriny the term of this Lease, Lessee, and not CFSI, shall pay when due all general ad valorem and property taxes to the extent such taxes exceed the taxes assessed against the Premises for 1982. Lessee shall pay all other law- ful public taxes and assessments, whether general, specific, or otherwise, assessed and levied upon or against the Premises or production therefrom, or attributable to Lessee's operations hereunder, or upon any property or improvements placed by Les- see ou the Premises for its own use, including all severance taxes; provided, however, that CFSI shall pay any income tax levied on any royalties paid to it by Lessee herein. Lessee shall have the right in good faith to contest any of the above taxes and assessments but shall not permit or suffer the Prem- ises or any part thereof, or any improvements or personal prop- erty thereon, to be sold at any time for such taxes or assess- ments. VIII. SURRENDER RENENAL AND TER[4INATTON 8.1 Termination by CFSI. CFfiI may te[minate this Lease, in the event of default by Lessee, as set forth in Section X below. 8.2 Renewal of Lease. CFSI expressly reserves the right reasonably to readjust and fix royalties payable hereunder and other terms and conditions at the end of the primary term here- of and thereafter at the end of each succeeding ten year period -6-
