CFaI has no knouledye o~ averse <br />clai-ants to its said title. <br />5.2 N.ineabiiity and 3oundaries, CF6I expressly makes no <br />warran*_ies or representations as to the existence, nature or <br />extent of or suitability for any purposes of limes*_one in the <br />Premises, nor does CFSI warrant the location of or make any <br />representations concerninc the boundaries of said Lands. Les- <br />see shall have no recourse against CF&I in the event the Prem- <br />ises should not contain limestone in quantities or conditions <br />suitable for the lessee's purposes. Lessee agrees to indemnify <br />and hold CF&I harmless from all claims alleging trespass by <br />Lessee arising out of its operations on the Premises or neigh- <br />boring lands. <br />VZ. ASSESShL NT WORK AND PATENT <br />6.1 Annual Pssessment Work, Lessee will perform, during <br />each assessment year during the term of this Lease, upon or for <br />the benefit of each of the unpatented mining claims forming the <br />Premises and for those additional unpatented raining claims <br />owned by CF&I, contiguous to the Premises and set out in Exhi- <br />bit B-1 hereto, assessment work of a value and character suf- <br />ficient to satisfy the requirements of the mining laws of the <br />United States and the State of Colorado. <br />6.2 Affidavits of Pssessmer,t. <br />(a) Lessee shall be responsible for the timely filing <br />of annual affidavits of labor with the coun*_y clerk of Garfield <br />County, Colorado and with the U.S. Bureau of Land ~;anagement; <br />Lessee shall furnish CFI copies of filings at the time of fil- <br />ing. <br />(b) Lessee shall advise CF6I of its plans for annual <br />assessment work no later than tlay 1 of each year and complete <br />same no later than 45 Gays prior to its Statutory due date. <br />6.3 Application for Patent. Lessee shall, to the best of <br />its ability, support any application by Cr^5I to the federal <br />government for patent of any or all of tire mining claims listed <br />in Exhibit B-1. Any expense incurred by Lessee as a result of <br />CFSI's request in such matter shall be reimbursed to Lessee by <br />CF6I, provided however t'riat Lessee's norr'.al improvement, mining <br />and development costs shall not be considered such expense in <br />any case. <br />VII. OP?RATING RIGHTS AtiD ?ROCEDUF~'S <br />7.1 Mining. Lessee agrees to cause all work, development <br />and mining to be done in a careful and work~:~anlike manner and <br />in accordance with sound mining and engi;eering practice. <br />7.2 Permitti~. <br />(a) CF6I understands that Lessee may make efforts to <br />obtain rights, per:^its, rezoning and other au*_horization from <br />-3- <br />
