<br />RESOLUTION CONCERNED WITH APPROVAL OF AN APPLICATION F'OR A SPECIAL USE PERMIT
<br />BY MID-CONTINENT RESOURCES,INC., TO PERMIT THE EXTRACTION AND PROCESSING OF
<br />NATURAL RESOURCES
<br />WHEREAS, the Mid-Continent Resources, Inc. has filed an
<br />application with the Board of County Commissioners of Garfield County
<br />(hereinafter, the "Hoard"), for approval of a Special Use Permit for the
<br />extraction and processing of resources in the Open/Space Zone District, on the
<br />real property described below;
<br />WHEREAS, based on the materials submitted by the applicant, khe
<br />recommendation of the Garfield County Planning Commission and the comments of
<br />the Garfield County Planning Department, this Board finds as follows:
<br />1. That proper publication and public notice was provided as
<br />required by law for the public hearing on August 9, 1982, before the Board of
<br />County Commissioners;
<br />2. That the hearing before the Board of County Commissioners was
<br />extensive, and complete, that all pertinent facts, matters, and issues were
<br />submitted and that all interested parties were heard at that meeting; and;
<br />3. That the proposed special use permit conforms to Section 5.03
<br />of the Garfield County Zoning Resolution of 1978, which is applicable to the
<br />approval or dissapproval of an application for a special use permit.
<br />WHEREAS, the Board must, for the purposes of analyzing the
<br />subject application against the provisions of the Garfield County Zoning
<br />Resolultion, establish the neighborhood which may be affected by the possible
<br />granting of the proposed special use permit, and further that the Board has
<br />determined that such neighborhood is that area of Garfield County, Colorado,
<br />which lies within one mile of the proposed site, and expressly includes within
<br />this area the city limits+of the City of Glenwood Springs, Colorado;
<br />WHEREAS, the Board finds that the general character of the
<br />neighborhood of the tract proposed to be subject to the special use permit is
<br />nonproductive mountainous terrain, with some limited mineral extractive uses,
<br />and residential areas which are urban in character, which are operated in
<br />compliance with all applicable zoning, subdivision, building, health, and
<br />sanitation regulations.
<br />WHEREAS, the Board finds that the impact of the proposed use would
<br />require denial thereof, due to impact upon the uses and value of adjoining
<br />properties in the neighborhood from blasting, noise and dust, and upon traffic
<br />volume and safety caused by truck traffic from the quarry site, unless certain
<br />conditions are imposed on the proposed permit to mitigate the impact on such
<br />uses, traffic and safety;
