(A) A request for the ~eencv's approval or disapproval of the operntions' <br />• (B) A notice [o the appropriate a,cncy that it must respond +vithin <br />30 days from the receipt of the request. <br />(iii) A permit for the operation shall not be issued unless jointly approved by all <br />affected agencies +vith jurisdiction over the park or historic site. <br />(fl For operations involvine the surface minitt~ of coal where the private mineral <br />estate to be mined has been severed from the private surface estate, the applicant has submitted to the Division the <br />documentation reguired under 2.03.6(2). <br />(a) The applicant has either: <br />(i) Submitted [he proof required by 2.07.6(11(b)(i); or <br />(ii) Made the demonstration required by 2.07.6(l)(b)(ii). <br />(h) The applicant or the operator, if other than the applicant, and all persons <br />who own or control the applicant, do not control and have not controlled mining operations with a demonstrated <br />pattern of willful violations of the Act of such nature, duration, and with such resultin¢ irreparable damaee to the <br />environment as to indicate an intent not to comply with the provisions oFthe Act. <br />(i) Surface coal mining and reclamation operations to be performed under the <br />ermit will not be inconsistent with other such operations anticipated to be performed in areas adjacent to the <br />proposed permit area. <br />(i) The applicant will submit the performance bond required under the bond of <br />Rule 3, prior to [he issuance of oemtit. <br />(k) The applicant has, with respect to both prime farmland and alluvial valley <br />floors, obtained either a ne¢a[ive determination or satisfied the requirements of 2.06.6 and 2.06.8, excludin;?, <br />undeveloped ranee lands which are not siKnifican[ to farmine on said alluvial valley floors and those lands upon <br />which the Board finds that the fanning which will be interrupted, discontinued, or precluded is of such small <br />acrease as to be of neeli~ible impact on said land's aericul[ural production. <br />(I) The proposed poshttiuine land use of the permit area has been approved by the <br />Division in accordance with the requirements of 4.16. <br />hn) The Division has made all specific appro+•als required under Rulc 4. <br />(n) The Division has found that the activities would not alTect the continued <br />existence of cndanecred or threatened species or result in the destruction or adverse modification of their critical <br />habitats as determined under the Endan~cred Species Act of 1973 (16 USC Scc. 1531 ct seq.) or the Noneamc, <br />Gndanaered or Threatened Species Conservation Act (Section 33-5-101 et seq., C.R.S.). <br />(o) The applicant has submitted proof that xll reclamation fees required by 30 <br />CPR Chanter VII.
