This
revision is made as a result of our telephone conversation on April
13, 1995 in which you indicated that the concrete tunnel and
conveyor support had now been demolished and disposed of and
committed to reducing the stockpile of broken concrete, previously
estimated to total over 5,000 cubic yards, to total no more than
500 cubic yards.
As a result of the complications introduced into the removal, by
April 30, 1995, of the major portion of the stockpile of broken
concrete, ie. the den of red foxes reported by Tom Henry of the
DOW, I have extended the due date for submittal of the revised
total amount of Financial Warranty to June 1, 1995. Mr. Henry
assured me that was ample time for the foxes to move on and you
have indicated that would be enough time for Valco to subsequently
complete the removal of all but 500 cubic yards of the broken
concrete.
In order that the new total for the Financial Warranty, ie.
$27,837, be considered adequate on June 1, 1995, it is to be
understood that the the concrete tunnel and conveyor support will
have been demolished and disposed of and that no more than 500
cubic yards of broken concrete remain stockpiled on the site.
