The applicant has <br />received the following notice of violation during the three-year period preceding the third permit <br />renewal application date. <br />NOV C-96-019 was issued on November 26, 1996 for "failure to construct or maintain sediment pond <br />as designed to Veat runoff or inflow". The sediment pond RP-1 primary spillway was leaking allowing <br />water to discharge without sufficient settling time. The problem was abated quicky as found by DMG <br />inspector during his inspection on November 27, 1996. A penalty assessment of $1,500 was <br />proposed by DMG. This fine was reduced to $550 after an assessment conference. <br />NOV C-97-0O6 was issued on May 20, 1997 for "failure to maintain surface water monitoring devices <br />• (crest stage gages and single stage samplers) in accordance with the monitoring program submitted <br />under 2.05.6(3)(b)(iv)". A minimal civil penalty of $550 was assessed by DMG. BME paid this fine <br />(Permit Renewal #3, 3/00) I-7 <br />
