The highway is operated and <br />maintained, but not owned, by the City of Colorado Springs under the authority <br />of a special use permit issued by the U.S. Forest Service. Under the terms of <br />the special use permit, the City is required to operate and maintain the <br />highway and associated facilities for public use at it's expense in lieu of <br />paying a fee to the United States. In effect, the City is acting as a partner <br />of the U. S. Forest Service and operating the road on behalf of the U.S. Forest <br />Service. <br />The site of the proposed mining is National Forest System land and the <br />minerals to be extracted are property of the United States. The United States <br />is not an adjoining landowner, but the actual landowner. The primary purpose <br />of the proposed borrow pit is to provide mineral material to maintain the <br />Pikes Peak Highway, but the U.S. Forest Service may also use the pit for other <br />minor projects from time to time. Such use would be coordinated with the <br />City. <br />In addition to the County and State permits, the City is required to obtain <br />approval from the Forest Service to use the pit. We plan to authorize this <br />use as a part of the new Pikes Peak Highway Recreation Corridor special use <br />permit which hopefully will be issued early next year. If the new highway <br />permit is not issued as soon as planned, a temporary permit will be issued to <br />authorize use of the borrow pit. <br />We have been working with the City for several months in evaluating this new <br />pit location, but have not fully reviewed their application to the State.
