Mosch, <br />File Number 82-75 <br />Gentlemen: <br />The application referenced above was delivered to me as one of the <br />adjacent landowners. This letter is being written to officially <br />place ~ comments in the record. <br />If the parties wish to mine the land for its mineral content then <br />it should not be considered a tourist attraction, even though a <br />tourist might come by and take a look. If on the other hand they <br />intend to conduct tours and charge a fee, it should not be considered <br />a working mine. <br />The mining survey showing its location was done in the late 1800's <br />and/or early 1900's, when survey technology was poor at best. These <br />old mining surveys have been proven to be off by as many as 1000 <br />feet. I feel strongly that the application should be denied and/or <br />postponed until an accurate up-to-date land survey is done. <br />With such a survey the applicants rights will be protected, as will <br />the rights involved with my claims. Any mining, construction or <br />dumping from the Phoenix Lode etc., that extends onto my claim can <br />be very costly, the applicant may not have enough funds to withstand <br />potential lawsuits. <br />What Alvin and Patricia Mosch do on their own property is their ovn <br />problem, but what they do that adversely affects my property and <br />access to my property is where my objections start. Mining underground <br />can affect my property, causing cave-ins and/or loss of minerals <br />from the Wearly Willie and Prosperity claims because a rich vein is <br />followed and I can't tell that they have crossed the property line. <br />Building construction and mining timbers also concern me since my <br />claims have considerable stands of wood on them, and can be eyed as <br />a source of mine timber or firewood. This assumption can be very <br />costly to the Mosch's, as any tree that has not been cut down by my <br />husband or myself will be considered to have been cut down by Mr. <br />Mosch and his company. <br />Settling Ponds and access to my land also concern me. Smelly, un- <br />sightly settling ponds are terrible, especially if they carry to my <br />land and/or water drains onto my land from them, or they block any <br />access that has been permited to date. <br />
