iOtdINfi COMPLIANCE <br />EXHIBIT M <br />• <br />COMPLIANCE WITH LOCAL ONING <br />The Fountain Colony Pit will be contained totally within the city limits <br />of Fountain, Colorado. Prior to completion of the permit application, the <br />various procedures required by Fountain to comply with the local zoning <br />ordinances were completed. The following pages are complete copies of the <br />zoning ordinance no. 766 which provided approval for the mining operation by <br />the City of Fountain. <br />The ordinance does not contain anything which would be contrary to this <br />• <br />• <br />plan, with one exception. The ordinance refers to 312 acres rather than the <br />applied for 313 acres. It appears that Fountain rounded the actual permit area <br />acreage downward to 312 while Fountain Colony Investment rounded it up to 313 <br />acres. The actual acreage in the permit area is 312.8 acres. The fact is that <br />the area of consideration shown on the maps presented in this application are <br />exactly like the maps provided to Fountain during their consideration. The <br />only difference is that the maps provided them were at a scale of 1" = 200' and <br />the maps in this application, in order to provide for more manageability by <br />Mined Land, are at a scale of 1" = 400' <br />Other than that all boundaries and <br />areas are identical. <br />page 1 of 5 Exhibit M <br />
