Banta. <br />Division Drteaor <br />Rte: Carbon Junction Mine (Permit C-82-054) Possible Reconsideration of Board <br />Urger to Deny Permit Renewal Application and Forfeit Reclamation Bond <br />During August 22, 23, 1990 Board Meeting. <br />Dear Mr. Hendricks: <br />As a follow up to Frank Johnson's letter of July 20, 1990, I am advising you <br />that I have taken the liberty of scheduling the Board's recent order in regard <br />to the Carbon Junction Mine to deny permit .renewal ana to forfeit bond for <br />reconsideration by the Board during its August 22, 23, 1590 meeting. This is <br />done to provide the earliest possible action by the Board to vacate the order <br />in the event that Pueblo Coal, Inc. is able to proviae acceptable replacement <br />bona and all necessary information for permit renewal on August 20, 1990 as <br />specified in Mr. Johnson's letter. If Pueblo Coal, Inc. is unable to supply <br />the required materials and bona by that date, reconsideration of the Board's <br />Order will be withdrawn as an agenda item for that meeting. <br />In regard to the mine itself, the Division will conduct inspections on a <br />monthly or more frequent basis until the status of the operation is finally <br />established. The Division would appreciate the cooperation of Pueblo Coal, <br />Inc. in maintaining the property in compliance as well as preserving access <br />during this period. <br />If you have any questions in regard to the above, please contact me. <br />Sincerely, <br />~- <br />James C.
