3.1.4 Public Use <br />The Operator/Applicantand Landownersdo not propose the use of this land by the public. Mining <br />will be done by an MSHA approved contractor and the public wilt not be allowed on site without <br />a company representative, Part 46 of MSHA will be followed on this site. After the site has been <br />released by the MINED LAND RECLAMATION BOARD, the Landowners may allow public <br />access if it is deemed beneficial to the landowners. <br />3.1.5 Reclamation Measures -Material handling <br />(1) Grading shall be carried on so as to create a final topography appropriate to the final land use <br />selected in the Reclamation Plan. <br />(2) Bacld'illing the excavated (mined) area will consist of overburden materials. Additionally all <br />backfill material will be compacted in place to insure stability. No toxic or acid-fomvng materials <br />will be on site nor will any be delivered to this mine site. <br />(3) All grading shall be done in a manner to control erosion and siltation of affected lands. All means <br />will be taken to prevent soil erosion. No highwalls will be left after mining. Best Management <br />Practices will be used to protect azeas outside the affected land from slides and other damage. No <br />highwalls are planned at this open pit mine. <br />(4) All backfilling and grading will be completed as soon as feasible after the mining process. The <br />operator will establish reasonable timetables consistent with good mining and reclamation <br />procedures. Gradingof backslopeswill be concurrentwith mining, andthe pit floorwill be contoured <br />for seeding as mining proceeds. Backsloping will be synchronized with mining as stated above. <br />Topsoiling will be accomplished after mining has moved away far enough to make it practical for <br />seedbed prep and seeding. Also, time of yeaz and weather conditions will play a role in this timing. <br />The NRCS recommendations will be followed for seeding and time of yeaz to plant. <br />(5) No refuse will be generated by this mining operation for cleaning and preparation of substances <br />mined. No acid-forming or toxio-producing materials wilt be mined or used for processing at this <br />sand and gravel mining -processing plant. Therefore, no plans have been developed for their <br />handling. <br />(6) There will not be any drill or auger holes unfilled after mining. Aii exploration will most likely <br />be done with small bore coring by a trained crew or by backhce in selectedareas, and after discovery, <br />all holes shall be backfilied as soon as possible. No adits or shafts will be employed in this open pit. <br />
