Ifyour mining and rec(arrmtion operations affect areas beyond rite boundaries ofan approved permit boundary, <br />substantial civil penalties, to you as pertnittee can result; <br />4. Any rtiodification to the approved mining and reclamation plan from those describedm yow approved <br />2 (~J/~J app&cation requires you to submit a penrtit modification and obtain approval from the Board or Office; <br />5. It is ywrr responsibility to notify the Office of any changes in your address or phone number, <br />6. Upon permit issuanceandprior tobeginning on-site mining activity, you must post a sign atdte enhance ofthe <br />mine site, which shall be cleary visible from the access road, with the following information (Ruk 3.1.12): <br />a the name ofthe operator; <br />b. a statearcnt that a reclamation permit for the operation has been issued by the Colorado Mined Land <br />Rechm~tian Board; and, <br />~- c. the permit ntmrber. <br />/~.~ 7. The boundaries of the pemmt boundary area must be marked by monuments or other markers that are clearly <br />~X,/5~~ visible and adequate to delineate such boundaries prior to site disturbattce. <br />8. It is a provision of this permit that the operations will be conducted in accordance with the terms and conditions <br />_.,~Q Gsted in }roar application, as well as with the provisions of fhe Act and the Construction Material Rtiles and <br />J~ Regulations in effect at the time the pemrit is is~ud. <br />9. Annually, on the anniversary date of permit issuance, you must submit an annual fee as specified by Statute, <br />and an annual report which includes a rrtap descnbing the acreage affected and the aceage reclaia>ed to date (ifthere <br />are changes form the previous year), any monitoring required by the Recbttrtatirm Plan to be submitted aonuallyon <br />the amtiversary date of the permit approval. For example, a <br />permit with the anniversary date of July 1, 1995, the annual fee is for the period of July 1, 1994 through lone 30, <br />1995. Faihue to submit your annual fee and report by the permit anniversary date may result in a civil penalty, <br />revocation of yow puntnit, affi forfeittm of your financial wtttramy. It is your responsibility, as the permittee, to <br />11 ~~~~ centinue to pay your armual fce to the Office until the Board releases you from your toEal reclamation responsibility. <br />"7~ 10. For ioint venturelnartnershin_operators: the signing representative is audto[iaed to sign this docrmuent and a <br />power of attorney (provided by the partner(s)) audiorizing the signature of the representative is attached to this <br />application. <br />Permit Condition: <br />T` _ A reportable spill is a spill of any toxic or barardous substance (including spills ofpetroleum pralucts) within the <br />mined land permit area reportable to any Division of the Colorado Depa<mient of Public Health and the Hnviromneat, ilie <br />National Resporr~ Center, the Cdotado Emergency Planning Commission, any local Emergency Planning Commission, <br />local Enrergaucy Plamuing Corrniittee, or the State Oil Inspector. The Mirre t)lrerator shall notify the Division of <br />Reclamation, Mining and Safety (DBMS) ofa reeportable ~r71 within the rniaed land pemut area using the same timeframe <br />required by the pemrit, license, notice, statute, rule or regulation governing the reporting of the spill to the other appropriate <br />agency. Notice ofa reportable spill shalt be FAXed ro: MineraB Program Supervisor, Division of Recla>r~tion, Miningand <br />Safety, FAX (303) 832-8106.
