• <br />Exhibit A <br />Attachment to Wagner Construction Condition¢~l Use Permit <br />C-99-03 <br />On April 13, 1999 the Moffat County Comrr.issioners approved the above referenced <br />Conditional Use Permit with the following conc!itions. <br />1. All Conditions stated by the Planning Commission. <br />2. A baseline of the stream will be estatlished. The flow of the stream will be <br />calculated by the Colorado Division of Water. Resources. The quality of the water <br />will be tested by ACZ. Additional quality tests can be obtained by other <br />interested persons at their discretion. <br />3. If blasting occurs, water quantity and q iality tests will be performed before and <br />after the blasting period. Jay Wagner will notify the Division of Water Resources <br />regazding the flow test. Mr. Wagner will give all interested parties 24 hours <br />notice so that they can obtain water samples for quality testing. If the interested <br />parties can agree on a test facility, the c~>st will be equally divided. If the parties <br />cannot agree on a test facility, the co~;t will be borne by each party desiring <br />additional testing. <br />4. Should there be a significant change in water flow or quality as a result of <br />blasting, any interested party can request that the conditional use permit come <br />before the county for further review. <br />
