P.adcliff <br />Denver, Colorado 8023 <br />Dear Mr, Johnston, <br /> <br />EIVED <br />0 <br />DIVISION <br />Natural Resources <br />Perusal of your application for a mining permit f ed <br />with the Colorado Mined lard Reclamation Board has rece tly <br />been made, Regarding your preaerit and future mini 9 <br />on the Alma Placer prompts this letter, <br />Mr, Conrad J, Schindler aryl a{pself are point-owner of <br />the Gumaer Placer east of and adjacent to the Alma Plat r. <br />(Please see your attached map), Ytro points will be pre ent <br />for your consideration both of which having great impo anc~ <br />to Schirdler and me and should be addressed during the Jay <br />22 azd 23. 1985 permitting hearings, <br />Point 1~ <br />Your application states your intended use of the C lumbia <br />Ditch as a water transmission conduit to the gold-wash' plant, <br />1lie Columbia Ditch (averaging some 10' in width and at east <br />3' in depth) traverses the Gumaer Placer for apprcucimat ljr 3600'. <br />Although the present and previous ovners have never bee granted <br />a formal Right-Of-Wa4y for the Ditch to cross the Gumaer Schisrller <br />and self recognize and honor the legitimate prescript ve/histor- <br />ical Right-Of-Wap for the Ditch over the Gumaer. (Hilt rically <br />the Ditch - to 1915 at least - vas located completel,}* o the <br />Alma Placer and immediately weat of the Gumaer Placer. eurce~ <br />1412. Colorado Geol. Survey Bu11..~3). ~e Ditch was r located <br />on the Gumaer subsequent3g to the discovery of an 'east rn <br />channel' of high gold concentrations on the Alma but d' ectly <br />beneath where the Ditch traversed formerly, The Ditch s then <br />re-located on the Gumaer primarily for~(1) to obtain a s Tong <br />hydrostatic head due to the higher topography of the er and <br />(2) to eliminate flooding in the newly discovered 'east n channel' <br />on the Alma Plaoer, (the former reason is precisely vhy a City <br />of Colorado Springs Water Pipeline also crosses the r in its <br />pa~esent location), <br />2lotwithstanding, Schindler and self do ask of you that <br />special consideration be given in instituting all possib a pre- <br />ventative measures to not allow portions of the Gumaer t be <br />flooded at ary given point along the Ditch, Blooding h oc- <br />curred previously and did prevent our access to areas of the <br />Gumaer to ydtich we sought accesa.
