<br />for the purpose of e:<tracting open
<br />LIHEREAS, on September 30 , 1978 ~ Summit Pressed Rrick & Tile "FILED" an
<br />nppii.cation,a reclankation Ulan and nap, and the requi;~ed tee, as required by law; and
<br />i:H}: P.E:15, on June 29 , 19 7a, the dined Land Reclamation Board approved
<br />ll~e Summit Pressed Brick & Tile application and set bond; and
<br />IdHERG:S, on June 29 19 78, the `fined Land Feclamation Board accepted
<br />scraty submitted by Summit Pressed Brick & Tile and such date shall be considered the
<br />;late of issuance of the per;nit and the anniversary date for all other purposes; and
<br />ldtiEREAS, the PLned Land keclamation Eoard has made a finding, for the purposes
<br />.:f issuing this permit, that:
<br />1) the app'_icstion complies with the requirements of the Colorado
<br />'lined Land Reclamation Act and all applicable local, state and
<br />Federal la4;s; and,
<br />2) the operation will not adversely affect the stability of any
<br />significant, valuable, and permanent man-made structures located
<br />within. two hundred feet of the affected land, except where there
<br />is an agreement between the operator and the ?arsons having an
<br />interest in the structure that damvge to the structure is to be
<br />compensated for by the operator; and,
<br />3) the proposed mining operations and reclamation can be carried out
<br />in conformance with [he requirements of C.3.5. 1973, 34-32-116, as
<br />amended (1976 Sess. La~~~s H.B. 1065); and
<br />[WHEREAS, for the purposes of issuing this permit, the operator has made a
<br />-._isfactory showing to the Roard that he F~i11 employ during and after his
<br />open mining operations procedures reasonably designed Co minimize
<br />:s much as practicable the disruption from the open mining operations
<br />:anal will provide for the rehabilitation of the affected land through the rehabilitation
<br />of plant cover, soil stability, water resources, and other measures appropriate to the
<br />:=ubsee,uent beneficial use of such mined and reclaimed lands; and that in the event
<br />of the failure of his proposed reclamation plan, he. gill take whatever measures which
<br />may be necessary in order to assure the success of reclamation of the lands affected
<br />y his open mining operations; and,
<br />IdN.EkF_lS, for the purposes of issuing this p~_rmit, a cony of the application
<br />~oproced by the Mined Land Reclamation Board of the State of Colorado is attached
<br />a ti~is ?ermit and thereby becomes a pare of the terms hereof.
