Division Director <br />10170 Church Ranch Way, Ste. 200 Natural Resource Trustee <br />Westminster, CO 80021 <br />RE: Baal Adequacy Review Comments -North Bank Pit, Regular 112 Application <br />Class: Permit, File No. M-2006-018 <br />Dear Mr. Vigil: <br />Listed below are final adequacy review comments on the above-captioned Regular 112 <br />application for 237.67 acres located 2.2 miles east of Rifle. Please respond to these concerns on <br />or before the October 10, 2006 decision date. <br />6.4.4 EXHIBIT D - Minint Plan <br />4a. The applicant has proposed a 100-foot setback from the Colorado River to the nearest point <br />of pit excavation in order to ensure that during high-water events, the river does not capture the <br />pit. As a point of clarification, the Division considers the setback from the Colorado River to <br />begin at the top of north bank of the river. Please affirm. <br />5. The applicant specifies that a primary crusher will be located adjacent to the active mining <br />area, and then the sand and gravel materials will be transported across the Colorado River via <br />conveyor to the Mamm Creek operation on the south side of the Colorado River. Please clarify <br />whether any portion of the conveyor/bridge system will remain during final reclamation. Please <br />respond. <br />6.4.7 EXHIBIT G -Water Information <br />18. The applicant has mentioned that Tamarix and Russian Olive trees exist within the proposed <br />permit boundary. The Division accepts the applicant's commitment to provide a weed control <br />plan within 90 days of approval of the Regular 112 Application. As requested previously, the <br />weed management plan will need to include specific treatment methods/strategies for each of the <br />following species that occur on site: Tamarix, Russian Olive, field bindweed, Canada thistle, and <br />Office of Office of <br />Mined Land Reclamation Active and Inactive Mines <br />
