• (f) If the applicant seeks a permit involving relocation of a <br />public road, a concise statement identifying the road, describing the <br />portion to be relocated, the route of the proposed relocation and the <br />duration of the relocation. <br />RESPONSE: <br />A copy of the Proposed Notice for the activities proposed at the Fish <br />Creek Tipple is provided in Exhibit 3, Newspaper Advertisement/Proof <br />of Publication. The advertisement was prepared in accordance with <br />each of the requirements stiplulated in Rule 2.07.3(2) and will be <br />published at least once a week for four consecutive weeks after the <br />Division notifies TCC that the permit application is complete. Proof <br />of Publication of the advertisement will be filed with the Division <br />not later than four (4) weeks after the last date of publication. <br />Twentymile Coal Company plans to permanently relocate a portion of <br />• County Road No. 179. The portion of County Road No. 179 which would <br />be relocated is that portion north of the junction with County Road <br />No. 33 in Section 13; Township 5 North, Range 86 West and south of the <br />junction with the Twentymile Coal Company haulroad in Section 1; <br />Township 5 North, Range 86 West, as shown on Map 1, Fish Creek Tipple <br />Surface and Coal Ownership. The route of the planned relocation would <br />be that portion of the Twentymile Coal Company haulroad between County <br />Road No. 179 on the north and County Road No. 33 on the south. <br />(4) (a) The applicant shall make a full copy of his or her complete <br />application for a permit, except for data and/or other information if it is <br />determined by the Division to be confidential according to 2.07.5, <br />available for the public to inspect and copy.
