<br />BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF CAMAS, INC., RIVERVIEW RESOURCES SITE, FILE NO. <br />M-1999-098, APPROVAL OF A 112 PERMIT APPLICATION OVER OBJECTIONS <br />THIS MATTER having come before the Mined Land Reclamation Board ("the Boazd") on March 22, <br />2000 for a hearing, the Board makes the following Findings of Fact and Conclusions of Law, and <br />enters the following Order: <br />FINDINGS OF FACT AND CONCLUSIONS OF LAW <br />1. On October 12, 1999, CAMAS filed a 112 Permit Application, File No. M-1999-098, <br />fora 340 acre surface sand and gravel mining operation in Weld County, Colorado, Secs. 32 and 35, <br />T6N, R66W, 6th P.M. <br />2. Timely objections to the application were received by the Division of Minerals and <br />Geology ("Division"). As a result, the Division held an informal conference pursuant to Construction <br />Materials Rule 1.4.6(I)(b) on January 7, 2000. ' <br />3. The matter was scheduled for the March 22, 2000 Board Hearing. <br />4. On Mazch 6, 2000, the Division issued a recommendation to the Board to approve the <br />permit application with one condition, that the setback from all critical structures be maintained at 200' <br />unless the Applicant submitted an acceptable slope stability analysis by 4p.m. March 9. On the same <br />day, the Division mailed its approval recommendation and recommendation rationale to the parties, <br />addressing the objections and concerns raised during the public comment period and informal <br />conference phases. <br />5. On Mazch 14, 2000, aPre-hearing Conference was held in Greeley, Colorado, to verify <br />the list of parties and to narrow and distill the issues to be considered by the Board at the final hearing. <br />Ms. Sandra Brown presided as the Pre-hearing Conference Officer designated by the Boazd. As a <br />result of the Pre-hearing Conference, aPre-hearing Order was generated, listing the parties and <br />outlining the schedule and time allotments for presentations at the final hearing. Two parties, Families <br />for Responsible Aggregate Mining (FRAM), and the City of Greeley, submitted written notifications <br />of their withdrawing as parties from this matter.
