Sa7io: 2.03.7 <br />extend no further south than the north edge of old State I-Lghway 133. The Sanborn Creek <br />• operations will, therefore, not involve mining or result in mining-related disturbance within the 6.6 <br />acres that have been identified as potentiallyunsuitable for mining. <br />A mining area maybe considered unsuitable if the affected area of the mine u, measured horizontally, <br />within 100-feet of the outside right-of-way line of any public road (Unsuitability Criterion No. 3). <br />Muting may occur within 100 feet of a public road if the procedures under Rule 2.07.6(d)(iv)(A)-(D) <br />are followed. The mine surface facilities aze within 100-feet of State Ifighway 133, however, these <br />facilities exist and operate in full compliance with applicable regulatory provisions since the mine <br />access road joins the highway right-of-way and opportunity has been provided for a public hearing <br />and written findings as specified in Rule 2.07.6 (2)(d)(iv)(A D). <br />OMI's existing surface operations are within 300 feet of both the Somerset Post Office and occupied <br />dwellings. Since the Somerset Mute is apre-existing operation that existed prior to January 4, 1977 <br />unsuitability criteria are not applicable and waivers from the owners of the dwellings are not required. <br />2.03.8 -Permit Term Information <br />Surface mirtittg activities (open pit or strip mirtittg) are not planned within the permit area. <br />Underground mining activities began on this property in 1902 and have been almost continuous since <br />chat date, except for a brief period from 1986 to 1990 when mining operations were in temporary <br />cessation, but surface coal handling and loading operations continued. Information on operational <br />scheduling and sequencing for each phase of mining as well as surface disturbance acreages and <br />mining extent u presented in Section 2.05.3. <br />Thu permit revision application includes environmental resource information for the projected life- <br />of-mine mining area and general operating and reclamation plan information for life-of-mine <br />operations in addition to more detailed information for the current permit term The current perrrut <br />term is October 11, 1998 through October 11, 2003. It is anticipated that OMI will continue to renew <br />the permit throughout the active mine life and that all subsequent permit renewal applications will be <br />for a permit term of five yt:ats, with the right of successive renewal. <br />2.03.9 -Personal Injury and Property Damage Insurance Information <br />A current Certificate of Insurance is on file with the DMG and a copy's included in this application <br />in Exhibit 2.03-E3, Insurance and Bonding Information. The existing policy meets applicable <br />regulatory requirements for minirrn~m coverage, will be maintained in full force doting the life of the <br />permit and all subsequent renewals, and includes a rider providing for notification of the DMG of any <br />substantive changes in or termination of the policy. <br />2.03.10 Identification of Other Licenses and Permits <br />(1) Permit to Store and Use Explosives No. 370 from the Colorado Division of Mmes, <br />Department of Natural Resources, 1313 Sherrrtan Street, Denver, CO. <br />(2) Colorado Department of Public Health and Environment, Water Quality Control <br />Division, 4300 Cherry Creek Drive South, Denver, 00., 80222-1530. Colorado <br />Discharge Permit System, CDPS Permit No. OQ0000132. Effective July 1, 1992, <br />renewed October 1996 to include stormwater management provisions previously <br />addressed under Stotmwater Pemut COR 040000. Modified to add Elk Creek Mme <br />• water discharge point (approved - 3/10/00), and to reinstate discharge from <br />Sedimentation Pond A-1 and add a new discharge point for Sedimentation Pond D <br />(approvals pending).
