May c , : 1 17 :59 IJo .004 P .04 <br />• • <br />Tenant is hereby authorized to maintain the existing berm which prevents the creek from <br />overflowing the Property and is authorized to maintain the existing road and cleared area. Tf <br />necessary to protect the road and cleared area from flooding, he is also authorized to improve and <br />enlarge the berm. Tenant may wt trees ss necessary and remove gravd from t}te waterfall and <br />stream bed to the south boundary Of the Property but shall not wt any trees or remove gravel <br />from the waterfall and stream bed to the north without the approval of Landlord. Tenant shall not <br />construct any permanent structures ur improvements on the Property during the term of the (case <br />without Landlord's prior approval. <br />Tenant further agrees, at his sole expense, to do or perform all of the following <br />obligations: al the expiration of this l.easo, if Tenant does not exercise his option to purchase, to <br />surrender and ddiver up the Property in as good order and condition as when the same were <br />entered upon, loss by fire, inevitable accident or act of God excepted; to use the Property for no <br />purposes prohibited by the laws of the United States, or of the State of Colorado or the <br />ordinances of rho City of Uuray, and for no illegal purpose whatsoever; to neither perntit nor <br />suffer any disorderly wnduct, raise or nuisance whatsoever about the Property; nor to use the <br />Property In any way or for any purpose which would render the insurance thereon void or the <br />insurance risk more hazardous, nor to pcrtrtit any mecltartics or other liens to be filed against the <br />Property. <br />During the tetra of this Lease, Landlord covenants, warrents end agrees that Tenant shall <br />peacefully and quietly have, hold and enjoy possession and use of the leased premises without <br />imerferenCC from Landlord or anyone acting for, on behalf of, or through, Landlord. <br />6. Waiver No assent, expressed or implied, to troy breach of any one of more of the <br />covenants or agreements hueof shall be deemed or taken to be a waiver of any succeeding or <br />other breach. <br />7. No Continuation of Tenancy Beyond the Term Hereof It is mutually agreed that, after <br />the expiration or cancellation of this Lease 8s provided herein, Tenant shall immediately vacate <br />the property. <br />8. Tenant's Default and Surrender It is expressly understood and agreed by and between <br />the parties that, if the rent above reserved, or any part therao~ shall be late, as that term is defined <br />above, or if default shall be made in any of the wvcnant s or agreements herein wnteined to be <br />kept by Tenant, Landlord may, after giving notice to Tenant at least ten working days prior to <br />doing so, declare the Lease term ended, and enter into the Property or any part thereof, either <br />wrth or without process of law, and dispossess arty person or persons occupying the same and <br />further to expel, remove and put out same, using such force as may be necessary to do so, witl!out <br />being liable to prosewtion or any damages therefor, and to repossess and enjoy the property. in <br />-4- <br />
