Dear Mr. Heifner: RECEIVED JUN 2 3 1977 RECLAMATION SECTION Colo. Dept. of Natural Resources According to your letter of June 1, there are certain things which we should comply with by July 1. You have indicated in your first paragraph that we must submit applications by July 1, 1977; however, we have already submitted the application, on your form, which would seem to be correct. Please notify us if any changes or additions are necessary thereon. Attached hereto is an irrevocable letter of credit from the Colorado Bank and Trust Company of Delta, Colorado, in the amount of $5,000.00 in lieu of bond. While we received the Cease and Desist Order, there is no Consent Agreement attached thereto. We would assume, that upon receipt of this letter, you will immediately send out the Consent Agreement for signature. We might add that on the 9.78 acres no actual mining had begun prior to May 1, 1977. However, to be technically correct, we submitted an application thereon, as a screening operation had been set up on the subject property. it would seem to be within the definition of "affected land" in the statute. Therefore, I would appreciate your showing the foregoing condition in the 9.78 acres so that it will be technically correct.
