Exhibit 51 <br />West Elk Mine ~ Lower Refuse Pile <br />Subsoil storage at the end of Phase IV was on the east bench of the LRP, as shown in Appendix B, Figure <br />2.OB. To begin construction of Phase V it was necessary to relocate the stockpile. In addition, it was <br />necessary to remove subsoil that had been replaced on the north slope above the bench and remove <br />subsoil that has been replaced under the topsoil pile on the bench on the north side of the pile. Subsoil <br />storage during the beginning of Phase V construction was along the western edge of the existing refuse <br />pile top, as shown in Appendix B, Figure 2.OE, until utilized for Phase V reclamation or moved to the <br />Sylvester Gulch Live Subsoil Stockpile #l. Surface water runoff was controlled with the sediment <br />control ditches already in place for the LRP. The pile will be continually borrowed from as the north and <br />east faces of the LRP are built and reclaimed. A 9 to 12-inch lift of subsoil will be placed directly upon <br />the reclaimed slope surface. Roughly 13,270-cy of subsoil will be required to reclaim the Phase V <br />construction. <br />•~ <br />• <br />10 <br />
