As the LItP will be reclaimed as it is constructed, topsoil and subsoil will be utilized from the stockpiles and

As shown on Figure LWP-002 through LWP-004 and Figure 2.0, a portion of the pile was located within
100 feet, measured horizontally, of the outside rieht-of--way of Colorado State Highway 133. Mountain
Coal Company received all necessary approvals from the Colorado Highway Department (see Appendix
C). [n addition, in compliance with rule 2.07.6(2)(d)(iv)(B) and (C) of the Colorado Mined Land
Reclamation Board Regulations, West Elk Mine has issued public notice and provided for a public hearing.
