Oehler, Environmental Protection Specialist RE: File No. M-97-054, Adequacy Items The following items must be addressed by the applicant in order to satisfy the applicable requirements of C.R.S. 34-32.5- 1 O1 et seq. and the Mineral Rules and Regulations of the Mined Land Reclamation Boazd: EXHIBIT C -Pre-Mining and Mining Plan Maps of The Affected Lands You have mazked the permit azea boundary with a heavy dark line on your Pre- Mining Plan Map. In accordance with Rule 6.2.1 (d), identify the line either on the map or the map index. The Pre-Mining Plan Map should be relabeled Pre- Mining/Mining Plan Map since it shows the mining operation as well as pre- mining conditions. This information can also be provided on two sepazate maps. u We have taken the latter option of presenting separate maps for the Pre- Mining Plan Map and the Mining Plan Map. See Exhibit C. 2. Please identify the owner of the lands immediately south of the proposed permit boundary and within 200 feet of lands to be affected by the mining operation. This is the land on the Pre-Mining Plan Map displaying no ownership symbol and lying along the route of the Arkansas River between land belonging to Mark Brown and the east map boundary. This laud is part of the Harvey Ranch under option by Agile. The owner will be Agile or its designated ranch operating entity. 3. Are there any utilities located in the raih•oad right-of--way. If so provide information in appropriate exhibits. There are no utilities located in the railroad right of way built for the project. The existing railroad right of way is outside of the permit boundaries. The poles and lines in the railroad right of way are outside the permit area, owned by the railroad and are for railroad purposes only.
