Historically, Pond "F" has proven suitable for watering livestock. Pond <br />"F" is an approved design impoundment being aself de-watering pond <br />and does not contribute to degradation of downstream waters <br />b} Sufficiently stable water level and a compatible pond configuration for <br />intended use; <br />Pond 'B" has held sufficient water level for watering livestock during the <br />scheduled grazing seasons and is configured with wide and gentle sloped <br />shores for the cattle's easy access to the water <br />c} Adequate safety and access for intended water users (i. e., <br />livestocklwildlifeJ ; <br />The shores of the impoundment gently slope across the pond for safe and <br />easy entry of livestock and wildlife. Also, the shores and the embankment <br />aze well vegetated- <br />d) Prevent diminution of water quality/quantity for arty affected water rights <br />holders; <br />Pond "F", designed as an approved sedimentation pond, functions to settle <br />out sediment from water run-off thereby benefiting the water quality. <br />Being a self de-watering pond, when the approved water levellvolume is <br />reached, the pond discharges through the standpipe enabling the water to <br />flow on downstream. <br />e} Adequately sized impoundment for intended use: <br />As stated in (b) above, given that the livestock is scheduled to graze <br />through the Pond "F" area in a relatively short duration and typically eazly <br />in the grazing season, the size of the impoundment has been adequate <br />fJ Impoundment suitable for approved post-mining use; <br />I am informed that the approved post-mining use is for livestock and <br />wildlife, therefore I believe Pond "F' is well suited for the intended use. <br />Sincerely, <br />~etY ~ . <br />Daniel McCarty <br />SILVER SPUR LAND & CATTLE, L.L.C. <br />Cowdrey, Colorado <br />r~i.~~~+ 42c <br />
