2.03.6 Right of Entry and Operations Information
The Colorado Coal Mine No. 1 property is owned by Kaiser Ventures, Inc. (Exhibit 1). A legal
description of the permit area is also contained in Exhibit 1. The following are legal.assignments.
(1) Quit claim deed and assignment dated March 28, 1985, by and between Colorado Coal
Resources Company, a Colorado limited partnership and Kaiser Steel Corporation, a
Delaware corporation, recorded April 25, 1985, in book 374 at page 40 in the office of
the Clerk and Recorder, Huerfano County, Colorado (Exhibit 1).
(2) Assignment of permits dated March 28, 1985, from Colorado Coal Mining Company, a
Colorado limited partnership, to Kaiser Steel Corporation, a Delaware corporation.
Assignment conveyed all operating licenses, permits, and agreements (Exhibit 1).
(3) Kaiser has applied to the State of Colorado [o acquire right of entry to the grassland
vegetation reference area located in Section 36 south of the permit area. Documentation
of this right of entry is contained in Exhibit 1.
2.03.7 Relationship to Areas Designated Unsuitable for Mining
(1) The permit area is not within an area designated unsuitable for surface coal mining
operations.
(2) No occupied dwellings are located within three hundred feet of existing surface
operations.
2.03.8 Permit Term Information
The area to be included in [he term of this permit is described in 2.03.6 above and shown on Map
1, Surface and Mineral Ownership. The permit term is a five (5) yeac period.

2.03.9 Personal Injury and Properly Damage Insurance Information
A copy of Kaiser's Certificate of Liability Insurance has been included in Exhibit 2. The original
