• Rule 2.06.5 - Permits Incorporating Variances from Approximate Original <br />Contour Restoration Requirements for Steep Slope Mining <br />(1) Scope. 2.06.5 applies to non mountaintop removal steep slope <br />surface coal mining and reclamation operations, where the operation is not <br />to be reclaimed to achieve the approximate original contour required by <br />4.14.1=4.14.6 and 4.27.3. <br />RESPONSE: <br />Since no steep slope mining is planned, the requirements of this Rule <br />are not applicable. <br />Rule 2.06.6 - Prime Farmlands <br />11 Scope. 2.06.6 applies to anv person who conducts or intends to <br />conduct surface coal mining activities on prime farmlands historically used <br />• for cropland. Areas where mining is authorized under permits issued or <br />mining plans approved prior to August 3, 1977, are exempt from the prime <br />farmland reconstruction standards. <br />RESPONSE: <br />As discussed under Rule 2.04.12, no prime farmland, as defined in Rule <br />1.04(95), exists within the proposed permit area. Therefore, this <br />Rule and the performance standards specified in Rule 4.25 do not apply <br />to this permit application. <br />Rule 2.06.7 - Variances for Delay in Contemporaneous Reclamation <br />Requirements in Combined Surface and Underground Mining Operations. <br />(1) Scope. 2.06.7 applies to any person who conducts or intends to <br />conduct combined surface mining activities and underground mining <br />• activities, where contemporaneous reclamation as required by 4.13 is not <br />2.06-4 <br />
