• fire, health, safety or environmental hazard caused by the mining and <br />recovery process; and <br />(d) Plans for monitoring surface and ground water and air <br />quality, as required by the Division. <br />~ No permit shall be issued for operations covered by 2.06.11, <br />unless the Division or Board first finds, in writing, upon the basis of a <br />complete application made in accordance with 2.06.11(2), that the operation <br />will be conducted in compliance with all requirements of these Rules <br />relating to underground mining activities and 4.29. <br />RESPONSE: <br />TCC does not intend to conduct surface coal mining and reclamation <br />operations utilizing in situ processing activities. Therefore Rules <br />2.06.11 and 4.29 are. not applicable. <br />• Rule 2.06.12 - Surface Coal Mining and Reclamation Operation Requirements <br />Involving the Removal of Coal from Coal Refuse Piles <br />1) Scope. The provisions os 2.06.12 shall apply to anv person <br />engaged in surface coal mining and reclamation operations who removes or <br />intends to remove more than 250 tons of coal from coal refuse piles within <br />12 consecutive calendar months in any one location. No person shall engage <br />in operations subject to 2.06,12 except under a permit or approval of a <br />revision to an existing permit issued by the Division in accordance with <br />the requirements of 2.06.12. <br />(2) Application contents. Each application for a permit or approval <br />of a revision to an existing permit subject to the requirements of 2.06.12 <br />shall contain that information required by 2.03, 2.04, 2.05 and 2.06 which <br />is necessary for the Division to make a written determination of compliance <br />with all requirements of the Act and these Rules in accordance with 2.07,6. <br />r~ <br />L <br />2.06-40 <br />
