Schmidt Living Trust dated May 13, 1996 and <br />FREDA SCHMIDT and CARL V. SCHMIDT, Trustees of the Freda Schmidt Living Trust dated May 13, <br />1996 of 20120 County Road 78, Towner, CO 81071, pazties of the fvst part, hereinafter called "Lessor" <br />(whether one or more) and the BOARD OF COUNTY COMMISSIONERS of ICiowa County, Colorado, <br />party of the second part, hereinafter called "Lessee". <br />WITNESSETH: <br />That the said Lessor for and in consideration of ten dollars and other good and valuable consideration <br />in hand paid, receipt of which is hereby aclmowledged and of the covenants and agreements hereinafter <br />contained on the part of the Lessee to be paid, kept and performed, has granted, demised, leased, and le! and <br />by these presents does grant, demise, lease and unto the said Lessee, its successors and assigns, for the sole <br />and only purposes of mining gravel and other related substances and for conducting all operations as may be <br />convenient or necessary for the mining and removal of gavel and related substances, including but not <br />limited to the construction of roads, excavation of gavel pits, reclaiming the same and doing all things as may <br />now be or hereafter become necessary to comply with the rotes and regulations of the State of Colorado and <br />the United States of America all that certain tract of land together with any reversionary rights therein, <br />situated in the County of Kiowa, State of Colorado, described as follows, to wit: <br />9.5 acres within: <br />The Southwest Quarter of the Southwest Quarter of the Northeast Quarter <br />(SW 1/4SW I/4NE1/4} of Section Twenty-six (26), Township Seventeen (17) <br />South, Range Foriy-two (42) West of the 6m P.M., Kiowa County, Colorado. <br />Il is agreed that this lease shall remain in force so long as Lessee conducts mining operations thereon <br />or a lease for five(5) years, renewable as long as able to conduct mining operations thereon and until Lessor <br />reclaims said property as may be requved bylaw. <br />In consideration of the premises the said Lessee covenants and agrees that the Lessee shall pay to <br />Lessor as royalty twenty cents ($.20) per yard for all gravel and similar substances removed from the <br />premises. <br />It is understood and agreed that the Lessee shall have possession of the surface of said premises <br />during the term of this agreement, <br />IN WITNESS WHEREOF, the pazties have hereunto set their hands and seal the day and year fvst set <br />forth above. <br />
