In the event that the applicant will need to relocate portions of either the Supple Ditch or the <br />Weiskopf Ditch that occur within the boundaries of the proposed permit area, the applicant need <br />to provide the following information: revised mine plan and reclamation plan maps showing the <br />new location of the relocated ditch or ditches, cross sectional designs for each ditch showing [he <br />current or undisturbed configuration and flow capacity of the ditch, and a commitment to relocate <br />each ditch in the same configuration and flow capacity as exists prior to mining. If there is any <br />need to enlazge the size of either ditch during relocation due to the addition of pit dewatering <br />flows, please indicate and provide cross sectional designs verifying the increased flow capacity. <br />Please address. <br />6.4.12 EXHIBIT L -Reclamation Costs <br />20. In the event that portions of or all of the Weiskopf Ditch and/or Supple Ditch will need to be <br />relocated, please indicate the number of linear feet to be relocated, an average unit cost per lineaz <br />foot for relocation, and the total cost of the relocation. Included should be costs for revegetation <br />or stabilization of the ditch embankment. <br />6.4.14 EXHIBIT N -Source of Leeal Rieht to Enter <br />21. The Division is awaze of a pending dispute regazding the validity of the applicant's lease <br />agreement with the landowner, and corresponding right of entry for purposes of mining and <br />reclamation. Copies of the complaint letter from Edward Bendelow on behalf of his client Mr. <br />Jarle Halsnes, dated October 30, 2001, have been forwazded to you. Please explain why you <br />believe Western Mobile Northern, Inc. has a clear and free lease agreement with the More Family <br />and corresponding right of entry for purposes of mining and reclamation and why you believe <br />the lease agreement provided in Exhibit N is adequate to demonstrate Western Mobile <br />Northem's right to extract sand and gravel products from the proposed permit azea. <br />6.4.19 EXHIBIT S -Permanent Man-Made Structures <br />22. In the event that either the Supple Ditch or the Weiskopf Ditch will need to be relocated <br />during the mining operation, the applicant will first need to provide a written waiver from the <br />owner(s) of either ditch verifying their agreement with the relocation, and any terms associated <br />with the relocation. Please respond. <br />
