<br />RIDER TO MINING PERMIT <br />Permit Date: December 9, 1999 <br />Petmit No: M-99-050 <br /> <br />The following additional stipulations and conditions form an integal part of the foregoing permit: <br />Stipulation No. Description <br />The Applicant must keep excavations at least two feet above the maximum goundwater <br />elevation until a Substitute Water Supply Plan is approved by the Office of the State Engineer <br />and proof of this approval is submitted to the Division. <br />2. If the depth ofexcavation exceeds 16 feet, and excavation is within 200 feet of any significant, <br />valuable, and permanent man-made structures not owned by the Operator, the amount of <br />required mining setback to the sWchue or right-of--way will be increased as necessary to be <br />two-times the depth of the excavation. <br />3. The total amount of fmancial warranty required for permit issuance is set at $5IQI98.00. <br />Upon the submittal and approval by the Division of a Technical Revision which includes a set <br />of standards and specifications and a quality assttrance plan for the lining of the pit the <br />fmancial warranty will be recalculated. <br />4. The Operator shall mine and backfill the northeast comer of the permit azea poor to mining <br />activities in Phase 4. The crest of the backfill must be at least as high as the adjacent <br />undisturbed areas and must be at least 400 feet from the crest of the bank at bank full stage of <br />the Cache La Poudre River. <br />5. The Operator shall develop, in consultation with Mr. Swift, a contingency plan for assuring <br />delivery of water to Mr. Swift, and shall submit the plan to the Division within 90 days of the <br />effective date of this Order. The Division shall have 60 days to review the plan and decide on <br />the plan's sufficiency. <br />6. The Operator shall submit to the Division revised plan maps showing the location of the <br />intended settlement ponds. <br />
