<br />°- N-6 Coal Company hes requested a small area exemption from the requirement to <br />construct sediment ponds to contain runoff from two topsoil stockpiles. One <br />• stockpile has an area of approximately 5 acres and the other is 3 acres_and <br />they are essentially in two separate drainage areas. For these reasons the <br />Oivislon has decided to grant a small area exemption for stockpiles B and C <br />pursuant to Rule 4.05.2(3)(b)(1). <br />The application is in compliance with the requirements of this section. <br />D. Drainage Structures <br />A post-mining drainage plan was submitted on September 29, 1986, which was <br />entitled Technical Revision 52. This plan describes and provides supporting <br />documentation for three permanent ditches and sixteen temporary diversions in <br />addition to the existing three temporary and one permanent diversion in the <br />mine pit area. There was considerable discussion about the adequacy of <br />armoring on two of the permanent drainages. The operator is aware of the <br />performance standards and the Division is now satisfied with the design. <br />The operation is in compliance with the requirements of this section. <br />XX. Bonding - Rules 2.05.4(2)(b) and 3 <br />The permittee currently has a reclamation bond in the amount of E 2,300,000.00 <br />filed with the Division. This bond is adequate to cover the next permit term. <br />The applicant is in compliance with the requirements of this section. <br />XXI. Sealin of Drilled Holes and Under round 0 enin s - Rules 2.05.4(2)( ) <br />an <br />The applicant has provided information on their drill.hole reclamation <br />practices in Section 2.05.4 of Volume I of the application and the operation <br />is in compliance with the requirements of this section. <br />XXII. Miscellaneous Co liance - Rules 2.05.6(5) .4.02 4.12 4.19 4.21 <br />an <br />No problems were identified with respect to the.requirements of any of these <br />sections during the review. Based on information provided in Volume I of the <br />application, the proposed operation is in compliance with alt of the <br />requirements of the above sections. <br />XXIII.
