PROPOSED DECISION <br />• Hayden Gulch Mine <br />The Colorado Mined land Reclamation Division proposes to approve with <br />stipulations an application fora permit renewal to permit C-003-80 submitted <br />by H-G Coal Company for the Hayden Gulch Mine. <br />This approval decision is based on a finding that the proposed operation will <br />comply with all requirements of the Colorado Surface Coal Mining Reclamation <br />Act, C.R.S. 1973, as amended, 34-33-101 et seq., and the Regulations <br />promulgated pursuant to the Act. <br />The permit revision application and the stipulations wilt become a binding <br />part of the permit upon approval. The stipulations for the Hayden Gulch Mtne <br />are as follows: <br />STIPULATION N0. 3 <br />THE PERMITTEE SHALL SUMS TAN EVALUATION OF THE MINE AREA HELLS FOLLONING ~ <br />DEVELOPMENT WORK ANO SEOUENT MONITORING ON OR BEFORE MAY 15, 1987, SHOULD ~. <br />HELLS CONTINUE TO EXHIBIT CHARACTERISTICS OF GROUT CONTAMINATION, THE <br />PERMITTEE SHALL SUBMIT A REVISED GROUND WATER MONITORING DLAN FOR MONITORING <br />THE LOWER AND UPPER COAL UNITS BY MAY 15, 1987, <br />Explanations of the stipulation can be found in Section VI of this package. <br />• This permit renwal decision will not be effective until all statutory notice <br />and public comment requirements have been satisfied. <br /> <br />-2- <br />i <br />
