Gary Fritz of the <br />Office of Surface Mining (05[11, Region V served upon tir. <br />Alan Czarnowsky, a representative of Kerr Coal Company <br />("KCC"), the referenced Notice of Violation reflecting three <br />separate alleged violations of the Surface Mining Control <br />and Reclamation Act ("ShICRA") and the Interim Regulations <br />promulgated thereunder, 30 C.F.R. §700.1 et sev. (42 F.R. <br />62675-62716). F:CC, while specifically reservi^.g the right <br />to contest the substance of these alleged violations, sub- <br />mits this letter, pursuant to 30 C.F.R. §723.15, containing <br />certain information pertaining to the alleged violations for <br />the consideration of the OStI Assessment Office in arriving <br />at a proposed penalty assessment. This information is set <br />forth in accordance with the various factors at 30 C.F.R. <br />§723.11 and §723.12 which must be taken into account in ar- <br />riving at a proposed assessment. •41e have attached photo- <br />copies of the Notices of Violation and thus will only <br />restate briefly the nature of the alleged violations. <br />A.
