<br />requires all grading to be done in a manner to control erosion and siltation of the affected <br />lands, to protect areas outside of the affected land from slides and other damage, and Rule <br />3.1.6, which requires that disturbances to the prevailing hydrologic balance of the affected land <br />and of the surrounding area and to the quantity or quality of water in surface and groundwater <br />systems both during and after the mining operation and during reclamation shall be minimized. <br />On December 14, 2006, the Division determined that the application for the Morgan Pit <br />satisfied the minimum requirements of the Act and Rules and approved the application <br />pursuant to Section 34-32.5-115(4) CRS. <br />Rule 1.4.11 provides opportunity for administrative appeal of the Division's decision to approve <br />the application. Petitions for administrative appeal must be submitted in accordance with the <br />requirements of Rule 1.4.11(1)(d).
