Conclusion. <br />The City has demonstrated that serious deficiencies exist with respect to the Bad <br />Boys pending application. It makes improper assumptions regarding slope stability without <br />having conducted appropriate geotechnical studies; it fails to adequately address proper <br />setbacks and subjacent and lateral support for the City's adjacent facilities; and, it is <br />premature because Bad Boys have not applied for required zoning permits from Teller <br />County. Moreover, their current pit is an unpermitted mining operation. <br />The City believes that the potential for off-site impacts to the City's adjacent water <br />facilities is high if the permit is approved as submitted.
