<br /> <br />STAFF REPORT <br />APPLICANT: Harriet Snare, DBA Bad Boys of Cripple Creek Mining <br />Co., Inc. <br />REQUEST: Conditional Use Permit for Recreational Activity <br />LEGAL DESCRIPTION OF PROPERTY/REQUEST: Roanoke Mining Claim, <br />MS#14096, Section 13, Township 15 South, Range 70 West <br />DATE OF LEGAL PUBLICATION: June 27, 1991 <br />DATE OF POSTING: June 28, 1991 <br />ADJOINING PROPERTY OWNERS NOTIFIED: YES X NO <br />COMMENTS: The applicants are requesting approval of a Conditional <br />Use Permit to conduct a Recreational Activity in an Agricultural <br />Zone (A-1). The request would allow the applicants to operate a <br />turquoise hunt for visitors to the Cripple Creek area. <br />The area in question in adjacent to the City of Cripple Creek and <br />involves 10 acres. The activity involves the placement of <br />turquoise into piles of earth, and then letting visitors search the <br />earth and "find" the turquoise. <br />The applicant has indicated that the hours of operation will be <br />from 8:00 A.M. to 6:00 P.M.. The site is fenced around the <br />perimeter, and another area will be fenced to further limit access, <br />both from the site and to the site. There will be 24-hour security <br />on the property, and the activity will be monitored by employees on <br />site. <br />Access to the property will be from Hayden Street, which is a City <br />Street in Cripple Creek. I have notified the City but have not <br />received a response. <br />I have received two letters related to the proposal. One is in <br />favor of the request and the other is opposed to the request. I <br />have attached both letters for your review, and I would like to <br />address the letter opposed to the application. In their letter <br />they feel that this is a "Purely Commercial Activity". I would <br />disagree with this statement, as Teller County has permitted a <br />similar operation in the past as a recreational activity, and this <br />was a gold panning operation between Divide and Cripple Creek. <br />The applicants project appears to be adjoining this individuals <br />property, with the Cogan house to the southeast of the property in <br />question. <br />Another issue the Cogan's raise is that of access. No county roads <br />are in involved with this request. The access is through Cripple <br />
