On page
5, "Exploration Permit" is listed, along with "Mining and Reclamation Permit", as one of
the approvals our agency would issue for construction and operation of the mine and
related facilities. Any drilling activity to be conducted within the proposed permit area
identified in the mining and reclamation plan permit application would be addressed within
the mining and reclamation permit itself, and would not require a separate exploration
approval. Drilling activity outside of the proposed permit boundary would need to be
addressed within an "Exploration Notice of Intent", which is the term used in the DRMS
regulations for application for coal exploration. I would suggest changing "Exploration
Permit" to "Exploration Notice of Intent (if exploration drilling outside of proposed
mining and reclamation permit area is proposed)".
In the second paragraph on page 6, the second sentence includes the phrase "...the
Colorado Division of Mining and Geology (now CDRMS)... At the time in question, the
agency that is now CDRMS was the Colorado Division of Mined Land Reclamation (later
changed to CDMG, and subsequently to CDRMS). "Colorado Division of Mined Land
Reclamation" should probably be used in the subject context.
Thanks for the opportunity to comment.
Daniel T.
