• ground water in the mining and adjacent areas, the mining operation and subsequent reclamation should have no <br />adverse effect on existing or potential ground water recharge capacities and adjacent users. <br />4.05.13 Si IRFA .RO WA R MONITORRJ <br />CEC will continue their current program of monitoring surface and ground water quality and quantity throughout the <br />term of the planned mining operations, as set forth in Exhibit 29, Water Quality Monitoring Manual -CEC. The <br />monitoring program will serve as an integral part of the program for protection of the hydrologic balance by detecting <br />any possible problems with respect to water quality or quantity. <br />4.05.14 TRANSFER OF WELLS <br />CEC does not presently plan to transfer any monitoring wells to water wells. <br />4.05.15 WATER RGHTS AND REPLACEMENT <br />CEC, if necessary, will replace the water supply of any owner of interest in real estate who obtains all or part of the <br />supply of water for domestic, agricultural, industrial, or other legitimate use from underground or surface source <br />where the water supply has been affected by the mining operation. <br />Ground water and surface water uses are limited in the vicinity of CEC. The uses are limited because of the lack of <br />available water in the area and relatively limited demand. <br />• CEC does not anticipate that any water supply or water right of any owner of interest will be affected by the mining <br />operation. Water rights in the vicinity of CEC were examined, with all water rights and well locations shown on the <br />Water Rights Map (Map 18). Wells in the vicinity are tabulated in Exhibit l 1, Water Rights. <br />a n5 16 Di AR WA R INTO N FRGRO <br />No surface water will be diverted or otherwise discharged into any underground mine workings. <br />4.05.17~OST-I\4iNINC RFHAAILITATION OF SEDIMENTATION PONDS DIVERSIONS IMPOUNDMENTS, <br />Sedimentation ponds and temporary diversions will be removed upon satisfaction of requirements in Section <br />4.05.2(2) of the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. <br />4.05.1 R STREAM B[JFFER ZONES <br />No mining or associated activities aside from the two (2) exceptions described below shall disturb any land within <br />] 00 feet of a perennial stream or a stream with a biological community as defined by Rule 4.05.18(3). The two (2) <br />exceptions are the coal storage silo and the 48-inch cross-country conveyor which have been previously approved by <br />the CMLRD. The locations of these two (2) structures are shown on the Structures and Renewable Resources Map <br />(Map 25). <br />4.06 TOPSOIL <br />• 4 06 I GENERAL REQUIREMENTS <br />All surface disturbance described in this application has occurted either during previous CEC operations or previous <br />to the CEC mining operation.
