Von Engeln, Nov 14, 1994. <br />File no.: M-87-171 Fountain Colony Pit <br />Dear Mc Dillie: <br />After receipt of your letter I discussed the matter with my client Mr. R.D. Von Engeln. Upon <br />consideration of the many facets of this issue Mr. Von Engeln desires to withdraw, at this <br />time, the request for reconsideration of the previous approval. Negotiations are continuing and <br />he is hopeful that agreement can be reached in the near future. But at this time there is no need <br />to move forward with reconsideration or permit modification. It is clear that under certain <br />conditions there would need to be some modifications to the original plan in addition to the <br />previously discussed matter of bringing the permit and plan up to date before work could <br />actually begin. <br />On behalf of Mr. Von Engeln 1 am therefore requesting that you remove the matter from the <br />December agenda and allow the issue to continue as it has in the past. If and when agreement <br />is reached regarding any development of the site for mining, I will inform you of such. We can <br />then decide, with the benefit of a clear direction regarding the future of the site, what exactly <br />needs to be done to allow issuance of the permit. <br />
