Permit application submitted to the Division in November 1987. <br />Z. Application approved in January 1988. Bond set at $51,000.00 for the phased operation. <br />3. Permit never issued since a bond was never submitted. <br />4. Applicant was noticed in November 1994 that the Division was going to request that the <br />Board reconsider [he previous approval of the permit application pursuant to Rule 4.1(2). <br />5. Applicant submitted a request to the Division in November 1994 to remove the matter from <br />the Board agenda and to allow the issue to continue as it had in the past. The Division <br />verbally denied the request. <br />6. Applicant submitted a request to the Division in December 1994 to place the item on the <br />Board agenda and asked that the Board reaffirm the previous approval and issue a permit. <br />The applicant asked that the bond be set at $5,000.00. <br />7. The Division notified the applicant that, since almost seven (7) years have passed, <br />renotification of the public would be required. The applicant complied with all the <br />notification provisions and requirements of the Act and the Rules. No objections were <br />received. <br />8. The Division suggested, and the applicant agreed, that a bond be submitted in an amount <br />equal to the estimated cost of reclaiming some kind of disturbance at the site if the Board <br />reaffirms the previous approval and accepts the applicant's proposal. <br />9. The applicant proposes [o limit the initial disturbance to one (1) acre comprised of minor <br />excavations (test pits). <br />10. The Division determined that the fmancial warranty requirements for one (1) acre of <br />disturbance would be $5,630.00. <br />11. As a condition of the Board's reaffirmation of the previous approval, the applicant agrees to <br />notify the Division sixty (60) days prior to the initiation of mining activities at the site so an <br />adequate financial warranty requitement can be determined by, submitted to, and approved by <br />the Division prior to the operator's disturbing more than one (1) acre. <br />
