<br />• ,pR s 1992 <br />Mined Land <br />2.03.5 COMPLIANCE INFORMATION Fjerlgr^~tinn n`"~'` <br />....................................................................................................................................................... <br />...................................................................................................................................................................... <br />....................................................................................................................................................................... <br />(1) American Shield has never had a Federal or State mining <br />permit suspended or revoked in the 5 years prior to the submittal <br />of this application. <br />(2) Does not apply. <br />(3) All of the violations listed below are for the Fruita Mines, <br />File ~ C-81-015, Interim Permit ~ 79/60/ug/c. The MSHA Mine ID <br />number for the site is OS-03170. All violations were issued to <br />Jack Crichton of American Shield and were issued by the Colorado <br />Mined Land Reclamation Division. <br />Violation C-89-021 issued on 9/21/89 for failure to protect the <br />hydrologic balance. Ditches along roads were in disrepair and the <br />repair work was done in a timely fashion to abate the violation. <br />• Violation C-90-030 issued on 7/23/90 for failure to conduct full <br />reclamation of the minesites in a timely fashion. The Division <br />required that the full reclamation of the sites take place before <br />July of 1990. American Shield was in a cash bind and could not <br />produce the money in time to avoid the violation. The full <br />reclamation was begun in the fall-winter of 1990-1991. Work was <br />completed by March of 1991. The violation was abated. <br />Violation C-91-005 issued on 6/18/91 for failure to conduct <br />mulching and seeding operations on topsoiled areas during the <br />first normal period for favorable planting. Some seeding was <br />completed within 60 days after the issuance of the violation. <br />Vegetation has taken hold on the site. <br />Violation C-91-006 issued on 6/18/91 for failure to pass all <br />disturbed area through a sediment pond or an approved small area <br />exemption. A small 0.2 acre area did not drain to the sediment <br />pond after the reclamation work was completed. The violation was <br />issued as a result of a ten day notice issued by OSM. The <br />violation required that a plan be submitted for a small area <br />exemption of the area. This was done. The plan showed how hay <br />bales would be anchored into the ground at certain intervals to <br />control sediment. The plan was approved and the work was <br />completed in a timely fashion to abate the violation. <br />• <br />pd <br />
