__
DEPARTMENT III IIIIIIIIIIIIIIII're for
David 11. Get ggg

MINED LAND RECLAMATION DI
DAVID C. SHELTON, Dlreclor
R is Hard D Lamm
Governor
September 14, 1983
Mr. John A. Auffrey
Bent County Courthouse
Las Animas, Colorado 81054
d
Re: Adams, Bent County, Etchart, U.S.
Dean, and Clodfelter pits.
File Nos. 83-177 through 83-183,
Dear Mr. Auffrey:
Army Corps of Engineers, Smartt,
respectively, inclusive
The complete letter concerning the 110 applications for the seven pits
captioned above that was sent to you on September 8, 1983 was in error
as to the tentative dates of consideration by the Mined Land Reclamation
Board. The letter gave the dates as November 16-17, 1983. The correct
dates are September 21-22, 1983. I am sorry for this error.
This is important considering the short time before the scheduled Board
meeting. To date, our Division has not received the Colorado Division
of Wildlife statements for these seven operations. Without these
evaluations, it is very difficult to do a proper adequacy review of these
applications. Without such a review by the Division (and your responses
to it) for all of these pits, I cannot recommend approval of these applica-
tions to the Board. Furthermore, publication (for 2 sequential weeks in
a local newspaper) must be completed before the upcoming meeting, or else
the Board cannot consider the applications. I think it quite likely that
this connot be accomplished in time.
Given this situation, I suggest that you give me a written request for a
continuance of Board consideration of these seven applications until the
October 26-27, 1983 meeting (or a phone request followed by a letter).
By that time, I am sure that these problems can be resolved and my adequacy
reviews of the applications can be completed and responded to by you.
Please call if you have any questions.
Sincerely,
" ~•
Mark S.
