<br />Subsequently, however, and as material is actually mined and <br />utilized from the Dollerschell pit, payment will be made as aforesaid. <br />Kehn agrees that any temporary structures which it may erect, <br />such as screening and crushing equipment, shall be done in a <br />reasonable, workmanlike manner and in accordance with Colorado Mined <br />Land Reclamation Rules and Regulations. Kehn also agrees to the <br />following special conditions: <br />1. The top 0.5' of any areas covered with overburden will be <br />stripped and stockpiled. <br />2. As excavation progresses and sufficient area becomes <br />available where reclamation can be accomplished which will not be <br />destroyed by subsequent gravel removal, the top 0.5' of overburden <br />which was stockpiled, and any excess overburden, will be spread over <br />portions of the pit floor. These areas will then be seeded, fertilized, <br />and mulched in accordance with recommendations obtained from the Soil <br />Conservation Service. <br />3. Any backslopea created by Kehn's excavation will be left <br />no steeper than 2:1. <br />4. Any overburden backelopea created by Kehn will be seeded, <br />fertilized and mulched as stated in Special Condition 2 above. <br />5. All machinery and equipment, asphalt and asphalt mix will <br />be removed from the owners' property. The pit and pit area is to be <br />left in a neat condition at the completion of Kehn's operation. <br />6. It will be Kehn's responsibility to obtain a mining and <br />reclamation permit from Colorado Mined Land Reclamation. The land <br />affected by the gravel operation will be reclaimed as outlined by the <br />rules and regulations governing the permit. The owners agree that they <br />will do nothing to adversely affect any of the reclaimed areas until <br />b. <br />Mined Land Reclamation has released Kehn from further responsibility <br />for the permitted area. . <br />Y <br />-2- <br />
