'FROM :SRGE HILL FAX N0. :970 785 6034 Rpr. 22 2002 03:SSPM P2
Mr. Anthony J. Waldron
23 Apri12002
.Page 5
4. Legal Agreement
I ask t}tgt as_a..eandition of any mining permit bein issued Dwens Carothers be require,
to contract a legal a rg Bement with the owner of tillage Hill Farm Wetlpn,. hich
reflects and incorporates, thc_wetland mitig tia ons pr„oc~dures as required by the Divisio0
of Minerals and Geoloav. This way the owner of the wetland has the option to
independently seek redress ifthe mitigation procedures are not implemented as agreed
upon, in addition to petitioning the Division of Minerals and Geology to enforce the
agreed upon mitigation procedures.
Cone/us~on l-laving studied this issue intensely for the past year, and having consulted
at length with various environmental experts, I have formed the opinion that the Sage Hill
Farm wetland will not escape some degradation due to the adjacent mining operation,
even if the mitigation procedures requested above are implemented. I think that the
wetland will shrink in size, most particularly in the northwest corner furthest from the
slough. However, my hope is that the slough will continue to act as a shallow seasonal
pond, thus providing important habitat in and of itself, and that at least some of the
wetland adjacent to the slough will survive.
Thank you for wnsideting the underlined requests stated above concerning the conditions
I would like to see placed on the mining permit as regards the wetland. If you have any
questions, I would be more than happy to discuss these concerns in greater depth.
In closing, I would like to commend Owens Brothers for their good-faith efforts over the
course of the past year to satisfy the diverse needs of the neighboring landowners, not
only as regards the wells and wetland, but also in other issues which are under the
jurisdiction of the County.
Most particularly, I would like to thank the staff of the Division of Minerals and
Geology, who have exhibited extreme sensitivity to the problem of protecting the Sago
Hill Farm wetland and who have insisted that this issue be addressed in a comprehensive
and responsible manner.
Sincerely
Cynthra Parker
Owner, Sage .dill Farm
Therefore, 1 ask that_as a condition of any ntinine Dermit being issued.
